RENTAL RULES (summary)
ASSOCIATION OF APARTMENT OWNERS OF MAUl BANYAN

CHECK-IN TIME IS AFTER 3 P.M. HST AND CHECK-OUT IS 11 A.M. HST. No early check-in or late check-out.

This is a NON-SMOKING unit. However, smoking is permitted outside and there is a smoking area on the south side of"Q" building.

Pets are not permitted in rental units under any conditions.

Guests must maintain quiet between the hours of 10:00 p.m. to 8 a.m. daily except on Fridays, Saturdays and nights proceeding holidays when quite hours shall begin at 12:00 midnight, in accordance with the House Rules of the AOAO Maui Banyan.

Hanging of towels, swimsuits, etc. from the lanai railings is not permitted. Glassware is not permitted in the pool areas.

In lieu of a damage deposit, renter agrees that any damages will be charged to the credit card used to secure the reservation. No damage charges will be assessed provided:

- No damage is done to unit or its contents, beyond normal wear and tear.
- No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
- All debris, rubbish and discards are placed in the dumpster.
- All keys are returned in the self-address, stamped envelope that will provided and the unit is left locked.
- All charges accrued during the stay are paid prior to departure.
- No linens, appliances, dishes, silverware, beach chairs, etc. are lost or damaged.
- No early check-in or late check-out.
- The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by the Association of Apartment Owners of Maui Banyan.

CANCELLATIONS - Cancellations that are made more than sixty (60) days prior to the arrival date are subject to a 5% cancellation fee or $ 50, whichever is greater. This is in addition to the nonrefundable 20% deposit placed at the time of booking.

Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment. Cancellation or early departure does not warrant any refund of rent.

MONTHLY RESERVATION CANCELLATIONS - Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in.

MAXIMUM OCCUPANCY - The maximum number of guests is limited to eight (8) persons. An additional charge of $10.00 per person per night for guest in addition to eight (8) will be assessed.
MINIMUM STAY - This property requires a five (5) night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.

INCLUSIVE FEES - Rates include a one-time linen and towel setup. Amenity fees are included in the rental rate.

NO DAILY HOUSEKEEPING SERVICE - While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit bath towels or linens to be taken from the units, but we provide beach towels for your use. For your convenience, certain items such as beach chairs, mats, etc. are also provided. A complete list will be provided with the keys and parking pass.

RATE CHANGES - Rates subject to change without notice.

FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

WRITTEN EXCEPTIONS - Any exceptions to the above-mentioned policies must be approved in writing in advance.

POOL ID: Maui Banyan charges a one time $20 fee per group and issues bracelets to each guest to be worn when using the pool. You can pay directly at the front desk and will be issued the bracelets at that time.

PARKING - A parking pass will be issued at check in. Renters must properly display the parking pass within the vehicle at all times. Failure to display may result in towing of vehicle at renter's expense. Parking is available in the covered parking garage or in front of the building. There is no reserved parking.

KEYS-Electronic room and pool keys will be issued upon check-in.

LIABILITY - Owners of the Maui Banyan and the Association of Apartment Owners of Maui Banyan are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities, nor are responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

ACTS OF GOD, GOVERNMENT, TERRORISM.  There are NO REFUNDS for acts of God, government or terror. Events such as (but not limited to) hurricane, tropical storm, weather conditions, earthquake, tsunami, pandemic, war, terrorism and any other act of God, government or terror. This applies even if a mandatory evacuation or travel restrictions are in effect.

ACKNOWLEDGMENT. Tenant acknowledges they have reviewed and understand the terms of this lease and agree to be bound thereby. Tenant further affirms that whatever mark they have chosen to make in the Internet booking form required field of same name is their "electronic signature" and is equal in every way to a handwritten signature on a paper document.

PRINTING AND DATA STORAGE OF CONTRACT. Rentor affirms that the entire text of this contract has been stored in a unique database record pertaining specifically to this rental. Rentor further instructs Tenant to print a copy of this contract for their own records. If Tenant is unable to print a copy Rentor will provide a copy upon request.
		
ELECTRONIC SIGNATURE. Tenant affirms that whatever mark they have chosen to make in the Internet booking form signature field is their "electronic signature" and is equal in every way to a handwritten signature on a paper document. 
		
DATA STORAGE OF CONTRACT. This booking contract will be stored electronically and a copy will be emailed to Tenant along with their booking confirmation. Additional copies will be made available upon request.
