The Condominium Complex charges a $30 resort fee to all guests checking in. For your convenience we automatically add and collect this fee when we process your booking; you will not need to pay this when you check in.

1.	TERMINATION. Â If the Tenant or any member of his party violates any of the terms of this agreement, Rentors may, at Rentors' sole discretion, terminate this lease with no refund of the used portions of the rents unless the property is able to be re-rented, and may enter the premises and remove Tenant, the members of his party and their belongings.

2.	OCCUPANCY AND PERMITTED USAGE. Â Tenants listed herein will be sole occupants of the unit during the entire rental period. Use of the premises may be denied for any reason to any persons not listed. There is no subleasing or time-sharing of the unit unless specifically indicated herein. Using the premises for any other activity, including, but not limited to parties or events is prohibited. Causing damage to the premises, any neighboring property, or acts which interfere with neighbors' right to quiet enjoyment of their own and community shared resources are not permitted. Remedy for violation of this paragraph may include forfeiture of your entire security deposit and immediate removal from the property without any refund.

3.	DEPOSITS & PAYMENT. Â A credit card will be charged for a 20% deposit upon booking and the balance is due 60 days prior to checkin and will be charged automatically to your credit card unless other arrangements have been made. The credit card will serve in lieu of a security deposit. All property must be returned in the same condition as when occupancy commenced and Tenants are liable for all replacements, repairs and labor required to return the unit to the condition it was in prior to occupancy.

4.	CARE OF PROPERTY AND CLEANING. Â The rental and surrounding property will be inspected and cleaned after your departure. The fee you have paid will provide for normal light housecleaning including washing of linens, dusting, sanitizing of surfaces, etc. HOLIDAY ARRIVAL FEE: All reservations that check in on Thanksgiving, Christmas, and New Years Eve will be charged an additional fee of $196, (this is in addition to the regular cleaning fee.) YOU ARE REQUIRED to leave the property in the same general condition that you received it making sure all dishes & utensils are clean and put away, counters & food preparing appliances are clean, floors are swept, and the home is generally in the same clean condition it was in when you checked in. All keys must be returned and any damages reported at checkout. If any deep-cleaning is required, the entire cleaning charge will be charged to you.

5.	CHECK-IN/CHECK-OUT. Â Arrival instructions and entry code will be emailed to you prior to your arrival. Check-in time is 3:00 p.m. and check-out time is 11:00 a.m. (HST). Early/late check in/out may be available on a case-by-case basis, please discuss this with us in advance of you need. A $50 per hour charge will be assessed against your security deposit for all un-approved late check-outs.

6.	CANCELLATIONS. Â All reservations cancelled with less than 60 days notice are subject to forfeiture of the full rental payment or security deposit. Â For cancelations with over 60-days notice (or re-rented nights if less than 60 days) will be refunded less 20% and less credit card processing fees.

7.	ACTS OF GOD, GOVERNMENT, TERRORISM. Â There are NO REFUNDS for acts of God, government or terror. Events such as (but not limited to) hurricane, tropical storm, weather conditions, earthquake, tsunami, pandemic, war, terrorism and any other act of God, government or terror. This applies even if a mandatory evacuation or travel restrictions are in effect.

8.	THE PROPERTY IS EQUIPPED and fully furnished including linens, blankets, pillows, towels, as well as an equipped kitchen. There will be charges for replacing any of these items which are found missing or damaged during your stay.

9.	WHAT YOU SHOULD BRING. Â Plan on packing your personal toiletry items. We provide only a limited supply of toilet paper, paper towels, dish liquid, cleaning products and other consumable items. You should plan on making a trip to the grocery store to replenish these items as you need them.

10.	APPLIANCE MALFUNCTIONS or service requests will be responded to as quickly as possible. Â There are no rebates or refunds issued to Tenants for any reason as every good faith effort is made to insure the property is maintained to highest standards.

11.	IN THE EVENT of circumstances beyond our control, we reserve the right to substitute comparable lodging or refund your monies in full. Tenant expressly acknowledges that in no event shall Rentors/Management/Agent be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving, for any damage, destruction or loss.

12.	NO SMOKING. Â Smoking is prohibited in the unit at any time. Failure to observe this rule will result in forfeiture of your entire deposit plus charges to remedy the damages caused.

13.	LOST, STOLEN OR ABANDONED ARTICLES. Â Rentors shall have no responsibility for lost, stolen or abandoned items. Â All items left after checkout are considered abandoned and will either be shared with future tenants (such as condiments, cleaning supplies, beach toys, etc.) or disposed of without further notice.

14.	TENANT'S Â LIABILITY. Â Tenant agrees to accept liability for any damages caused by Tenant or tenant's guests, including, but not limited to misuse of appliances, furnishings, or equipment furnished. If damages are in excess of the security deposit being held, Tenants agree that Rentors may charge any credit card on file relating to this rental. If credit card(s) on file cannot cover all charges, Tenant will reimburse for costs incurred to repair/replace damaged items within ten (10) days of notice.

15.	HOLD HARMLESS. Â Rentor does not assume any liability for loss, damage or injury to persons or their personal property. Tenant acknowledges that all amenities included are without warranty or guarantee of any kind.

16.	INDEMNITY. Â The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Rentors from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Rentors and Owner free and harmless of any claim or suit arising therefrom.

17.	JURISDICTION. Â Any action concerning the rights, duties or liabilities of the parties to this agreement will be decided within the State of Hawaii, County of Maui and the prevailing party shall be entitled to recover reasonable attorney fees and costs.

18.	ACKNOWLEDGMENT. Â Tenant acknowledges they have reviewed and understand the terms of this contract and agree to be bound thereby.
		
ELECTRONIC SIGNATURE. Tenant affirms that whatever mark they have chosen to make in the Internet booking form signature field is their "electronic signature" and is equal in every way to a handwritten signature on a paper document. 
		
DATA STORAGE OF CONTRACT. This booking contract will be stored electronically and a copy will be emailed to Tenant along with their booking confirmation. Additional copies will be made available upon request.
