RENTAL AGREEMENT - KOA RESORT 5I 3BR TOWNHOME 
			
Payment Policy: 20% of the total balance will be charged by credit card at time of booking. The remaining balance will be charged to your card on file 90 days prior to arrival.

ADVANCED PAYMENTS AND FINAL PAYMENT

1.  Owner must receive full payment of the rental amount due no later than 90 days prior to arrival date.

2. Reservations made less than 90 days in advance of arrival date require full payment within 7 days after the booking.

3. If payment is not received by the due date, owner has the right to cancel the reservation. Be aware that it can take up to 5 business days to receive your check.

SECURITY DEPOSIT
Your booking credit card serves in leu of a cash security deposit on this rental. An inspection of the premises will be performed immediately after the Guests depart. If no damage has  occurred, the security deposit will just drop off your credit card If Owner or property manager determines that there has been damage or extra cleaning is needed to the premises caused by the Guest, more than normal wear & tear, the guest sill be notified and the credit card on file will be charged accordingly.

CANCELLATION / REFUNDS
All cancellations made at least 90 days prior to arrival date are subject to a $200 processing fee and less 20% deposit. All cancellations must be made in writing - which can be made via email. 
For cancellations less than 90 days before arrival date, your money is forfeited unless we can re- book,  in which case dates which have been rebooked will be refunded less processing fee and 20% deposit.

No refunds will be made for EARLY departure or if the number of guests decreases. IF YOU DO NOT FOLLOW KOA RULES AND ARE ASKED TO LEAVE, NO REFUND WILL BE GIVEN. PLEASE READ ALL RULES FOR KOA RESORT.

ACTS OF GOD, GOVERNMENT, TERRORISM.  There are NO REFUNDS for acts of God, government or terror. Events such as (but not limited to) hurricane, tropical storm, weather conditions, earthquake, tsunami, pandemic, war, terrorism and any other act of God, government or terror. This applies even if a mandatory evacuation or travel restrictions are in effect.

CHECK IN / CHECK OUT
Check in is at 4:00 p.m. and check out is at 10:00 a.m.

TRASH
Trash bins are at the front of the parking lot as you drive in. YOU ARE responsible for taking your trash out. There will be a $25 charge or more depending on trash left, if we dispose of extra trash (excessive).

LINENS / TOWELS
You will be provided with bed linens, bath towels and beach towels. Guests shall not remove the linens and towels from the premises. Guests are also responsible for returning the beach towels to the premises, if removed, otherwise you will be billed for the missing items.

About 1 week prior to your arrival, we will email you the access codes to the property(keyless entry). If the pool key is lost, a $100 fee will be deducted from the credit card on file. Please assure that all doors and windows are securely locked and the lights and AC units are turned off. Gates to pool MUST remain locked for safety. DO NOT leave key in gate.Make sure pool key is put back on hook before leaving.

MISCELLANEOUS
1. Housekeeping services are required if the stay is over 2 weeks. This will be paid separate, by you, on a weekly basis ( in full upon arrival ).

2. This contract is binding and cannot be modified or terminated by any change of circumstances.

3. Owner must be notified of any desired change in reservation dates as soon as possible.

4. Guest must leave the house on the date and time designated unless an extension is prearranged.

5. Owner is NOT responsible for any personal effects left in the unit.

6. House may not be sublet or assigned without prior consent of Owner.

7. Should the premises be destroyed by fire or other casualty so as to become unfit for human habitation, the agreement shall be ended with a refund to the tenant for any term unused.

8. Dangerous materials - Guests shall not have or keep on premises any article or thing of a dangerous, flammable or explosive character that might substantially increase the danger of fire on the premises, or that might be considered hazardous materials.

9. Guests shall not disturb, annoy, endanger or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises.

10. Guests agrees that during the term of their stay, they will keep the premises clean and free of trash, garbage, or other waste: and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of their stay.

11. Guests shall not paint or make alterations to the property including changing existing locks or adding new ones without written consent. DO NOT MOVE FURNITURE AROUND. IF FLOORS ARE SCRATCHED OR DAMAGED OR WE NEED TO MOVE FURNITURE BACK, THERE WILL BE A CHARGE.

12. Maximum occupancy provisions are for your safety. There will be an additional $100 charge per day for each excess person over booking details.

13. Shoes are NOT to be worn INSIDE the home, especially if guests have returned from the beach with sand. Please leave your shoes outside by the porch or immediately inside the door.

14. Please notify Maureen Bond of any problems immediately. You have 24 hrs to let us know of any broken items or problems otherwise you are responsible.

15. There is no lifeguard on duty at the pools and the Owner is not responsible for any incidents that may occur. Kids under 12 are not to be left in the pool area without adult supervisions.
		
ELECTRONIC SIGNATURE. Tenant affirms that whatever mark they have chosen to make in the Internet booking form signature field is their "electronic signature" and is equal in every way to a handwritten signature on a paper document. 
		
DATA STORAGE OF CONTRACT. This booking contract will be stored electronically and a copy will be emailed to Tenant along with their booking confirmation. Additional copies will be made available upon request.
