RENTAL AGREEMENT - THE WAYFINDER
			
DEFINITIONS
"Rentor" means all parties involved in renting the vacation rental to the guest. Including, but not limited to, property owner, property managers, rental agents and salespeople. 
"Tenant" means all parties who have paid for or residing in the property rented.

1. TERMINATION. If the Tenant or any member of his party violates any of the terms of this agreement, Rentor may, at Rentor's sole discretion, terminate this lease with no refund of the used portions of the rents unless the property is able to be re-rented, and may enter the premises and remove Tenant, the members of his party and their belongings.

2. OCCUPANCY AND PERMITTED USAGE. Tenants listed herein will be sole occupants of the unit during the entire rental period. Use of the premises may be denied for any reason to any persons not listed. There is no subleasing or time-sharing of the unit unless specifically indicated herein. Using the premises for any illegal activity is prohibited. Causing damage to the premises, any neighboring property, or acts which interfere with neighbors' right to quiet enjoyment of their own and community shared resources are not permitted. Remedy for violation of this paragraph may include forfeiture of your entire security deposit and immediate removal from the property without any refund.

3. DEPOSITS/FEES. A credit card will be kept on file in lieu of a $1000 security deposit. After termination of occupancy all real and personal property must be in the same condition as when occupancy commenced and all terms of this agreement met. Tenants are liable for all replacements, repairs and labor required to return the unit to the condition it was in prior to occupancy.

4. PAYMENT. A credit card will be charged for a 20% deposit upon booking and the balance is due 60 days prior to checkin and will be charged automatically to your credit card unless other arrangements have been made.

5. CARE OF PROPERTY AND CLEANING. The rental unit and surrounding property will be inspected and cleaned after your departure. The cleaning fee you have paid will provide for normal housecleaning including washing of linens, dusting, sanitizing of surfaces, etc. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure all trash is securely bagged, dishes & utensils are clean and put away, counters & food preparing appliances are clean, and the home is generally in the same clean condition it was in when you checked in. All keys must be returned and any damages reported at checkout. If any deep-cleaning beyond the actual cost of our cleaner is required an additional cleaning charge will be assessed.

6. MAUI COUNTY HOUSE RULES. The County of Maui requires these specific house rules for all vacation rentals on our island: Quiet hours from 9pm to 8am, during which time noise shall not unreasonably disturb adjacent neighbors. Sound that is audible beyond the property boundaries of the short-term home during non-quiet hours shall not be more excessive than would be otherwise associated with a residential area. Amplified sound that is audible beyond the property boundaries is prohibited. Vehicles shall be parked on the property. No parties or group gatherings other than registered guests shall occur.

7. CHECK-IN/CHECK-OUT. Check-in time is 3:00 p.m. and check-out time is 10:00 a.m. (HST). Key(s) must be returned at check out or a $50 key fee will be charged. Early/late check in/out may be available on a case-by-case basis, please discuss this with us in advance of your need. A $100 per hour charge will be assessed for all un-approved late check-outs. If our cleaner is made to wait to gain access after checkout, additional cleaning fees will be applied. If an unapproved late checkout interferes with our next booking, additional charges may be assessed based on circumstances and remedy for guests affected. If you are not in the unit at the time of checkout we may pack and/or remove your belongings in order to clean and place the unit in a check-in state for our next guests. There may be additional charges for packing, removing and/or storing belongings.

8. CANCELLATIONS. Cancellations with at least 60 days notice will be refunded the full amount less 20%. Cancellations made less than 60 days prior to checkin date are subject to re-rental and a cancellation charge equal to the entire rate for each night which can not be re-rented. For nights we are able to re-rent at the same amount you paid, you will be refunded the nightly re-rental amount less 20%. No refund exception to this policy will be given for cancelations under circumstances outside of those for which the Rentor is directly responsible. Travel insurance is widely available from many sources to cover these types of risk which we will not refund. Examples of circumstances which will not affect our refund policy are not limited to: weather, illness and Tenant family emergency.

9. THE PROPERTY IS EQUIPPED and fully furnished including linens, blankets, pillows, towels, as well as an equipped kitchen. There will be charges for replacing any items which are found missing or damaged during your stay.

10. WHAT YOU SHOULD BRING. Plan on packing your personal toiletry items. We provide toilet paper and cleaning products. Paper towels, dish liquid and other consumable items are usually stocked, though they are not guaranteed. You should plan on the possibility of making a trip to the grocery store to replenish any items as you need them.

11. APPLIANCE MALFUNCTIONS or service requests will be responded to as quickly as possible. There are no rebates or refunds issued to Tenants for any reason as every good faith effort is made to insure the property is maintained to highest standards.

12. IN THE EVENT of circumstances beyond our control, Rentor reserves the right to substitute comparable lodging or refund your monies in full. Tenant expressly acknowledges that in no event shall Rentor be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving, for any damage, destruction or loss.

13. ACTS OF NATURE & EMERGENCIES. There are NO REFUNDS for acts of God, nature or emergencies beyond our control. This includes any and all events natural or manmade, even if a mandatory evacuation is ordered.

14. TRAVEL INSURANCE. Tenant understands that they can obtain travel insurance for their protection and are STRONGLY ENCOURAGED to obtain a policy to protect their vacation investment against unforeseen events.

15. NO SMOKING. Smoking is prohibited inside the cottage at any time. Failure to observe this rule will result in forfeiture of your entire deposit plus charges to remedy the damages caused. If you choose to smoke outside, you must fully extinguish your butts and dispose of them properly.

16. LOST, STOLEN OR ABANDONED ARTICLES. Rentor shall have no responsibility for lost, stolen or abandoned items. All items left in the cottage after checkout are considered abandoned and will either be shared with future tenants (such as condiments, cleaning supplies, beach toys, etc.) or disposed of without notice.

17. TENANT'S LIABILITY. Tenant agrees to accept liability for any damages caused by Tenant or tenant's guests, including, but not limited to misuse of appliances, furnishings, or equipment furnished. If damages are in excess of the security deposit being held, Tenants agree that Rentor may charge any credit card on file relating to this rental. If credit card(s) on file can not cover all charges, Tenant will reimburse for costs incurred to repair/replace damaged items within ten (10) days of notice.

18. HOLD HARMLESS. Rentor does not assume any liability for loss, damage or injury to persons or their personal property. Tenant acknowledges that property is similar to a rugged wilderness camping type experience, and as such, all amenities included are without warranty or guarantee of any kind.

19. INDEMNITY. The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Rentor from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Rentor free and harmless of any claim or suit arising therefrom.

20. JURISDICTION. Any action concerning the rights, duties or liabilities of the parties to this agreement will be decided within the State of Hawaii, County of Maui and the prevailing party shall be entitled to recover reasonable attorney fees and costs.

21. ACKNOWLEDGMENT. Tenant acknowledges they have reviewed and understand the terms of this lease and agree to be bound thereby.

ELECTRONIC SIGNATURE. Tenant affirms that whatever mark they have chosen to make in the Internet booking form signature field is their "electronic signature" and is equal in every way to a handwritten signature on a paper document. 
		
DATA STORAGE OF CONTRACT. This booking contract will be stored electronically and a copy will be emailed to Tenant along with their booking confirmation. Additional copies will be made available upon request.
