RENTAL AGREEMENT - SURFSKI RENTAL - EPIC V10 GEN 4 ULTRA
			
PARTIES

THIS RENTAL AGREEMENT is made Between Owner: MauiGuidebook.com, LLC dba Surfski Maui

&  
Renter: The Undersigned Party

EQUIPMENT RENTED:  
Epic Surfski & Accessories

RENTAL TERMS AND CONDITIONS  
1)	Renter shall keep and maintain the rented equipment, during the terms of the rental, at his/her own cost and expense. With Exception to normal wear and tear, they shall keep the equipment in a good state of repair.

2)	Renter shall pay Owner full compensation for replacement of any equipment which is not returned because it is lost or stolen. Or full compensation for repair of any equipment which is damaged and in need of repair in order to put it in the same condition it was in at the time of rental. Ownerâs invoice for replacement or repair is conclusive as to the amount Renter shall pay under this paragraph. NOTE, If Damages more than $500, arrangements will need to be made to compensate Surfski Maui for undue devaluation due to damage repairs.

3)	Renter shall collect the equipment from Surfski Maui and return the equipment to Owner at the same location, on the date specified above, at Renterâs risk.

4)	Rental charges are billed to Renter for the full term even if equipment is returned before the end of the term. If the rental equipment is not returned during or at the end of the rental term, then the full rental charges shall continue on a full-term basis for any additional term or portion thereof until the equipment is returned.

5)	Renter authorizes the credit card provided herein to be charged for any purchases, damages and/or open balance remaining due for goods or services.

6)	Renter indemnifies and holds Owner harmless for all injuries â to this regard Renter shall agree to a waiver and release of liability clause.

7)	Renter shall pay all reasonable attorney and other fees, expenses and costs incurred by Owner in protection of its rights under this rental agreement and for any action taken by Owner to collect the equipment and/or any amounts due to Owner under this Rental agreement.

All terms are accepted by Renter below and reaffirmed upon collection of the equipment.

WAIVER AND RELEASE OF LIABILITY

IN CONSIDERATION of being permitted to rent equipment and/or participate in any way in Surfski Maui programs and related activities ("Activities") I, for myself, my personal representatives, assigns, heirs, and next of kin:

1)	ACKNOWLEDGE, agree, and represent that I understand the nature of Paddlesports and related Activities and that I am qualified, in good health, in proper physical condition to participate in such Activity and willingly agree to comply with stated and customary terms and conditions of participation. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately notify the nearest Surfski Maui representative(s) and discontinue further participation in the Activity.

2)	FULLY UNDERSTAND that: (a) Paddlesports and related ACTIVITIES INVOLVE RISKS AND DANGERS OF DAMAGE TO PERSONAL PROPERTY AND SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the conditions in which the Activity takes place, or the NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation or that of the minor in the activity.

3)	HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Surfski Maui, its instructors, instructor trainers, administrators, directors, agents, officers, members, volunteers, and employees, or any other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM LIABILITY, CLAIMS, DEMANDS, LOSSES, INJURIES, DAMAGE TO PROPERTY, OR OTHER DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, to the fullest extent permitted by law. I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND IMMEDIATE AGREEMENT I, or anyone on my behalf, makes a claim against any of the RELEASEES, I WILL RELEASE, INDEMNIFY, AND HOLD HARMLESS EACH OF THE RELEASEES from litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT

ELECTRONIC SIGNATURE. Renter affirms that whatever mark they have chosen to make in the Internet booking form signature field is their "electronic signature" and is equal in every way to a handwritten signature on a paper document. 
		
DATA STORAGE OF CONTRACT. This booking contract will be stored electronically and a copy will be emailed to Renter along with their booking confirmation. Additional copies will be made available upon request.
